1.2 CUSTOMER

These General Terms and Conditions of Sale (hereinafter the “Terms and Conditions”) apply to customers who qualify as “consumers” within the meaning of the introductory article of the French Consumer Code, i.e. any natural person acting for purposes outside their trade, business, craft, liberal profession or agricultural activity (hereinafter the “Customer(s)”).

They may also apply to a “non-professional”, i.e. any legal entity not acting for professional purposes, only where expressly provided for by law.

Any professional wishing to obtain information about the terms and conditions applicable to them must contact MERCI using the contact details provided above.

ARTICLE 2 – SCOPE

These Terms and Conditions define the conditions applicable to the sale of products offered on the website www.mercamerci.com (hereinafter the “Site”).

Products offered for sale on the Site are hereinafter referred to as the “Products”.

These Terms and Conditions do not apply to purchases made in physical stores, which remain governed by the general terms and conditions of sale available in those stores.

Placing an order on the Site constitutes the Customer’s full and unconditional acceptance of these Terms and Conditions.

MERCI reserves the right to amend these Terms and Conditions at any time and without prior notice. Only the Terms and Conditions in force on the date on which the Customer places an order shall apply, to the exclusion of any other MERCI terms and conditions, whether specific, previous or subsequent.

The Customer may consult the current version of the Terms and Conditions at any time by visiting the “Terms and Conditions” section of the Site. It is the Customer’s responsibility to check the Terms and Conditions in force before placing any order.

MERCI’s failure to invoke any provision of these Terms and Conditions shall not be construed as a waiver of its right to invoke that provision at a later date.

These Terms and Conditions are available at all times on the Site and may be downloaded by the user by clicking here.

ARTICLE 3 – PRODUCTS

3.1 General

The Products sold by MERCI are those displayed on the Site when it is consulted by the Customer.

The Product description that shall prevail is the one published on the Site at the time the order is placed. Each Product has a detailed product page setting out its essential characteristics (including unit price, available sizes and colours, composition, geographical traceability of the three main stages of production [weaving/knitting, dyeing/printing and manufacturing/assembly of the finished product], as well as any specific characteristics) and containing one or more photographs of the Products.

Customers are invited to refer to each Product’s description to learn about its properties and specific characteristics and, in particular, to determine whether it meets their requirements. The selection and purchase of a Product are the Customer’s sole responsibility.

The Products are described and presented as accurately as possible. Although MERCI makes every effort to ensure that the colours and patterns of Products shown in photographs on the Site accurately reflect the original Products, minor differences may occur, particularly depending on the resolution and colour settings of the Customer’s screen. MERCI therefore cannot be held liable for minor differences between the Products and their photographs on the Site.

The Products comply with the regulations in force in France, particularly those relating to personal health and safety.

Customers may contact MERCI using the contact details provided in Article 1.1 to obtain any additional information they require about the Products.

3.2 Availability

Products are sold subject to availability. Information concerning Product availability is provided on the Site, on the Product page and when the order is placed. MERCI makes every effort to keep Product availability information regularly updated.

However, despite all precautions taken, a Product ordered may exceptionally no longer be available. In such circumstances, MERCI undertakes to inform the Customer immediately and, where applicable, to refund all amounts paid using the same payment method previously used by the Customer.

MERCI shall not be held liable if one or more Products are unavailable on the Site.

MERCI reserves the right to change the Products offered on the Site at any time and without prior notice.

ARTICLE 4 – PRE-ORDER PRODUCTS

4.1 Definition and Availability

MERCI may offer certain Products for pre-order before they are released or restocked (hereinafter a “Pre-order”). These Products are clearly identified on the Site by a specific “Pre-order” notice.

4.2 Delivery Times

Pre-order Products are delivered on the date or within the period indicated on the Product description page when the Customer confirms the order (the “Delivery Time”). If no specific date or period is indicated, delivery shall take place no later than thirty (30) days after conclusion of the contract.

In the event of a delay beyond the stated Delivery Time, the Customer may require MERCI to make delivery within a reasonable additional period. If MERCI fails to make delivery within that additional period, the Customer may cancel the order in writing.

In the event of cancellation, MERCI shall refund the Customer all amounts paid no later than fourteen (14) days following cancellation.

4.3 Payment

Payment for Pre-order Products is made when the order is placed, under the same terms as those set out in Article 6.3 (Payment).

ARTICLE 5 – PRICES

Product prices are those displayed on the Site on the date of the order. They are stated in euros, inclusive of all taxes, excluding delivery charges and, where applicable, customs duties, import taxes or other charges payable upon delivery. Such duties, taxes and charges, the amount of which is beyond MERCI’s control, remain payable by the Customer and shall be paid directly by the Customer to the relevant authorities or carrier.

Delivery charges vary depending on the delivery method selected and the delivery destination. They are communicated to the Customer when the order is placed and are stated inclusive of all taxes, excluding customs duties, import taxes or other charges payable upon delivery.

MERCI reserves the right to change its prices at any time and without prior notice. Products shall be invoiced at the prices in force when the order is confirmed.

If an incorrect and manifestly derisory price is displayed for any reason (including a computer bug or technical, manual or human error), MERCI reserves the right to cancel the order and refund all amounts already paid.

ARTICLE 6 – ORDERS

6.1 Product Selection and Shopping Cart Review

After reviewing the Products offered by MERCI and, where applicable, contacting MERCI customer service, the Customer is invited to select and enter the required Product characteristics (colour, size, etc.) and quantities and add them to the virtual shopping cart by clicking the “Add to Cart” button.

The Customer is then shown a summary of the order (Product references, quantities, unit prices, prices including tax, etc.), allowing the Customer to amend the order before finalising it.

6.2 Identification, Address and Delivery Method

Once the order has been reviewed and confirmed by clicking the “Pay” button, the Customer is invited to identify themselves.

The Customer may:

either log in to their customer account by completing the relevant fields;

or create a customer account. The Customer must then provide the following information:

Email address
First and last name
Address
Postcode
City
Country
Telephone number

The Customer may also choose to receive communications from MERCI by email and/or mobile phone.

Creating a customer account allows the Customer to modify and/or supplement their personal data and consult their order history.

If a customer account is created, the Customer is informed that the account is strictly personal. The Customer therefore undertakes to keep it secure and never disclose it to third parties. The Customer undertakes to notify MERCI immediately upon becoming aware of any fraudulent use of the account. If the password is lost or stolen, the Customer may request that MERCI generate a new password.

Alternatively, the Customer may complete all mandatory fields if they wish to continue with the order without creating an account.

The Customer is then invited to select or enter their billing and delivery addresses and choose one of the delivery options available for the delivery address provided. For further information regarding delivery methods, the Customer is invited to consult Article 6.1 of these Terms and Conditions.

6.3 Payment

Once the above steps have been completed, the Customer is invited to select one of the payment methods offered on the Site:

Credit or debit card: Carte Bleue, Visa®, MasterCard®, American Express®, Maestro®, Discover®, JCB and Diners Club International® credit and debit cards are accepted. The Customer must provide their card number, the cardholder’s name, the expiry date and the three-digit security code shown on the back of the card. For American Express cards, the Customer must provide the four-digit security code.

The card authorisation request is made when the order is confirmed on the Site, except where servers are unavailable. MERCI reserves the right to submit a new authorisation request if the first request could not be completed due to server unavailability.

MERCI implements all necessary measures to ensure the confidentiality and security of banking data transmitted on the Site. The Site uses an online payment security system that encrypts Customer data. Payment information is transmitted in accordance with the highest security standards. Banking data transmission is handled by MERCI’s partner Stripe. Stripe acts as a technical service provider and does not handle disputes relating to orders, which are dealt with directly by MERCI as stated above or, where applicable, by the Customer’s bank.

All information exchanged for payment processing is encrypted using SSL (Secure Socket Layer) protocol: such data cannot be detected, intercepted or used by third parties. At no time does the Customer’s financial information pass through MERCI’s IT systems. Stripe verifies that the connection to the Customer’s browser is secure before sending the payment form to the banking institution processing the financial transaction.

In accordance with Article L.221-11 of the French Consumer Code, no later than upon delivery, the Customer shall receive written confirmation of the price paid for each item, detailing the price of the items and any delivery charges payable by the Customer.

PayPal: By selecting this payment method, the Customer is automatically redirected to the PayPal platform. If the Customer does not yet have a PayPal account, they may create one at that time. PayPal’s terms and conditions then apply. Once the order has been confirmed through PayPal, the Customer is redirected to the Site’s confirmation page.

Apple Pay: Available only if the Customer uses an Apple device and has enabled Apple Pay.

Google Pay: Available only if the Customer uses a Google device and has enabled Google Pay.

Alma (payment in instalments): MERCI offers Customers the option of paying for their order in two, three or four instalments free of charge. By selecting this payment method, the Customer is automatically redirected to the Alma platform. Alma’s terms and conditions then apply. The Customer is invited to consult those terms via the link provided and follow the relevant payment procedure. This payment method is available only for orders of at least €150, paid using a bank card issued in France and delivered in France. Alma remains free to accept or reject the transaction, particularly for security reasons. Any transaction rejected by Alma will result in cancellation of the order. Any termination or cancellation of these Terms and Conditions shall result in termination of the applicable terms between the Customer and Alma.

The Customer warrants to MERCI that they have all necessary authorisations to use the selected payment method.

The Customer is informed that MERCI reserves the right to suspend an order and request any additional information necessary to ensure that a payment method is not being used fraudulently. In the event of non-payment, an incorrect billing address or any payment-related issue attributable to the Customer, MERCI reserves the right to block the order until the matter has been fully resolved.

Once the payment method has been selected and the required information entered, the Customer is invited to read and accept these Terms and Conditions and our Privacy Policy.

The Customer may then proceed with payment for the order.

6.4 Order Confirmation

Once the Customer’s payment has been accepted, the Customer will receive an order confirmation email summarising the essential characteristics of the order (order number, items ordered, total amount, billing and delivery addresses, delivery date, etc.) and containing, or allowing the Customer to download or print, these Terms and Conditions. If this is not the case, the Customer is invited to contact MERCI customer service.

The Customer’s confirmation of the order and the order confirmation email sent by MERCI following acceptance of payment constitute the conclusion of a sales contract between the parties and acceptance of these Terms and Conditions.

The Customer therefore expressly agrees to the use of email by MERCI to confirm the contents of the order.

MERCI recommends that the Customer retain this summary on an electronic medium.

Some emails may be classified as spam. MERCI therefore recommends that Customers check their spam folder to ensure that they have not missed their order confirmation and summary.

MERCI nevertheless reserves the right not to confirm an order on legitimate grounds, including but not limited to:

  • previous abusive complaints;
  • use of fraudulent payment methods;
  • orders involving abnormal quantities;
  • previous abusive exchanges or returns;
  • existing dispute(s) with the Customer.

MERCI customer service is available to answer any questions concerning the Customer’s order using the contact methods set out in Article 1.1.

6.5 Order Archiving

The order confirmation is recorded in MERCI’s records, which are themselves stored on a reliable and durable medium. The Customer acknowledges that this confirmation constitutes evidence of the contractual relationship between the parties.

In accordance with Article L.213-1 of the French Consumer Code and Decree No. 2005-137 of February 16, 2005, for any order of €120 or more, MERCI retains information relating to the order for ten (10) years. This information may be provided to the Customer upon request to MERCI using the contact details set out in Article 1.1.

Customers are advised to retain a copy of the information relating to their order in electronic and/or paper form.

ARTICLE 7 – RETENTION OF TITLE

Products ordered remain the property of MERCI until their price has been paid in full.

ARTICLE 8 – DELIVERY

8.1 Delivery Locations

Products may only be delivered to countries for which delivery is offered on the Site. Orders cannot therefore be placed for delivery addresses outside the countries listed on the Site.

Products are delivered exclusively to the delivery address provided by the Customer when placing the order. The delivery address cannot be changed after the order has been confirmed by MERCI.

8.2 Delivery Methods

When placing an order, the Customer selects a delivery method from those offered by MERCI, which vary depending on the delivery address provided.

MERCI will notify the Customer by email when an order has been dispatched and, where applicable, provide tracking information.

8.3 Delivery Charges

Delivery charges are stated in euros (€), inclusive of all taxes, and are payable by the Customer. These charges may vary depending on the delivery method, Product weight and delivery destination.

The exact amount of the delivery charges is communicated to the Customer when selecting the delivery method and before payment of the order.

8.4 Delivery Times

MERCI makes every effort to comply with the delivery times communicated when the order is placed.

Any significant delivery delay exceeding the stated timeframes, subject to a maximum period of thirty (30) days, must be reported to MERCI as soon as possible using the contact details provided in Article 1.1. The Customer may then request a new delivery date or cancellation of the order.

The Customer is informed that incomplete or inaccurate contact information may result in a delivery delay for which MERCI cannot be held liable. In such circumstances, MERCI also reserves the right to cancel the order thirty (30) days after the originally scheduled delivery date. Additional charges relating to a further delivery attempt may also be charged to the Customer.

For deliveries subject to customs formalities, the stated delivery times may be affected by inspections or customs clearance procedures carried out by the competent authorities. If an order is held by customs, MERCI will inform the Customer as soon as reasonably possible after becoming aware of the situation and will take the steps incumbent upon it to enable delivery of the order. MERCI shall not be held liable where the delay results exclusively from the Customer’s failure or refusal to complete the required formalities, provide requested information or documents, or pay customs duties, import taxes or other charges for which the Customer is responsible. Other delays relating to customs procedures shall be handled in accordance with the applicable legal provisions governing delivery.

An order may, where applicable, be shipped in several consignments. The Customer will then be informed by email.

Delivery is deemed to have taken place when the Customer, or any third party designated by the Customer, signs the acknowledgement of receipt for the order at the delivery address specified when the order was placed.

8.5 Apparent Issues Upon Delivery

Risk in the Products passes to the Customer when the Customer takes physical possession of the relevant Products.

The Customer must check the condition of the packaging and the conformity of the Products delivered upon receipt.

In the event of an apparent issue (opened or damaged parcel, missing, damaged or non-conforming Products), the Customer is invited to inform MERCI within forty-eight (48) hours using the contact methods specified in Article 1.1, so that MERCI can carry out the necessary checks and, where applicable, exercise its remedies against the carrier.

In the event of missing Products, a return or refusal of Products by the Customer under these circumstances, MERCI will refund the relevant Products upon receipt and after verification by its teams.

These provisions do not deprive the Customer of their rights under the statutory right of withdrawal and legal warranties.

8.6 Delivery of Furniture and Bulky Items

Furniture and bulky items are delivered by a specialist carrier.

Specific charges: Due to their weight and volume, specific delivery charges apply. The amount is clearly communicated to the Customer when confirming the shopping cart and before the order is confirmed.

Access conditions: Before ordering, the Customer must check that the dimensions of the Products, as stated on the Product page, allow them to be transported through the usual access routes to the delivery location, including doors, stairways and lifts. MERCI cannot be held liable where delivery is impossible due to restricted or inaccessible premises. If delivery is impossible for this reason, the Product will be returned to MERCI and the resulting return costs shall be borne exclusively by the Customer.

Appointment: The carrier will contact the Customer directly to arrange a delivery time slot. If the Customer is absent at the agreed time, the Customer may be charged the costs associated with a further delivery attempt.

ARTICLE 9 – WARRANTIES

MERCI undertakes to provide the Customer with a Product that conforms to the contract and is free from defects in conformity when delivered, meaning that the Product shall be fit for the use normally expected of similar goods and shall have the characteristics described at the time of sale.

The consumer has a period of two (2) years from delivery of the goods to invoke the statutory warranty of conformity in the event of a lack of conformity existing at the time the goods were delivered.

During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared (this period is twelve (12) months for second-hand goods).

The statutory warranty of conformity entitles the consumer to repair or replacement of the goods within thirty (30) days of the request, free of charge and without significant inconvenience to the consumer.

Where the goods are repaired under the statutory warranty of conformity, the consumer benefits from a six (6)-month extension of the original warranty.

Where the consumer requests repair of the goods but the seller requires replacement instead, the statutory warranty of conformity is renewed for a period of two (2) years from the date on which the goods are replaced.

The consumer may obtain a reduction in the purchase price while retaining the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, where:

  1. the professional refuses to repair or replace the goods;

  2. the goods are repaired or replaced more than thirty (30) days after the request;

  3. the repair or replacement causes significant inconvenience to the consumer, particularly where the consumer ultimately bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;

  4. the lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a reduction in the price of the goods or termination of the contract where the lack of conformity is sufficiently serious to justify an immediate price reduction or termination. In such circumstances, the consumer is not required to first request repair or replacement of the goods.

The consumer is not entitled to terminate the sale where the lack of conformity is minor. Any period during which the goods are unavailable for the purpose of repair or replacement suspends the remaining warranty period until the repaired goods are returned.

The rights described above arise from Articles L.217-1 to L.217-32 of the French Consumer Code.

A seller who, in bad faith, obstructs implementation of the statutory warranty of conformity may incur a civil fine of up to €300,000, which may be increased to up to 10% of its average annual turnover (Article L.241-5 of the French Consumer Code).

The consumer also benefits from the statutory warranty against hidden defects pursuant to Articles 1641 to 1649 of the French Civil Code for a period of two (2) years from discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are retained or a full refund in exchange for returning the goods.

In the event of non-conformity or a hidden defect, the Customer must contact MERCI either by post at 84 rue Amelot, 75011 Paris, France, or by email at eshop@merci.paris.

When returning a Product, the returned Product must be accompanied by all accessories and the purchase invoice and must be suitably protected. These warranties may be exercised at no cost to the Customer, in accordance with Article L.217-11 of the French Consumer Code, provided that the Customer is entitled to rely on the relevant warranty.

ARTICLE 10 – RIGHT OF WITHDRAWAL / RETURNS

10.1 Period for Exercising the Right of Withdrawal

In accordance with applicable legislation, and in particular Articles L.221-18 to L.221-28 of the French Consumer Code, the Customer has fourteen (14) days following receipt of the Product to exercise their right of withdrawal, without having to provide a reason or incur any penalty. The period begins on the day following receipt of the Product. If it expires on a Saturday, Sunday, public holiday or non-working day, it is extended until the next working day.

For an order covering several Products delivered separately, or an order consisting of several batches or parts delivered over a specified period, the withdrawal period begins upon receipt of the final item, batch or part.

10.2 Exclusions

The right of withdrawal cannot be exercised for the contracts listed in Articles L.221-2 and L.221-28 of the French Consumer Code, including contracts for:

  • the supply of goods made to the consumer’s specifications or clearly personalised;
  • the supply of services fully performed before the end of the withdrawal period where performance began after the consumer’s prior express consent and express waiver of the right of withdrawal, once the service has been fully performed by MERCI;
  • the supply of goods liable to deteriorate or expire rapidly;
  • the supply of sealed goods which have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection;
  • the supply of a newspaper, periodical or magazine, except subscription contracts for such publications;
  • the supply of goods which, after delivery and by their nature, are inseparably mixed with other items.

10.3 Exercising the Right of Withdrawal

To exercise their right of withdrawal, Customers are invited, before expiry of the period specified above, to notify MERCI customer service of their decision to withdraw as follows:

  • by using the withdrawal form provided in the appendix to these Terms and Conditions; or
  • by using the online functionality available by clicking “Make a Return” at the bottom of the Site. The Customer is then invited to enter the order number and the email address used for the order and click “Find my order”. When the Customer uses this online functionality, acknowledgement of receipt of the withdrawal is sent on a durable medium, including the contents of the Customer’s declaration and its date and time.

10.4 Returning the Product

After exercising the right of withdrawal, the Customer receives a prepaid return label. In accordance with Article L.221-23 of the French Consumer Code, the Customer has fourteen (14) days following notification of the decision to withdraw to return the relevant Product(s).

Products must be returned to:

SED - Merci. BAT D1 Porte 33
1 rue Jean Jaurès
ZI de Moimont 1
95670 Marly La Ville
France

Returns to stores will not be accepted.

Returned Product(s) must be accompanied by the return form provided by MERCI, available through the customer account or supplied by customer service.

In all cases, Products must be returned in their original packaging, together with any accessories, and in a condition allowing their immediate resale. The Customer may be held liable for any reduction in the value of the items resulting from handling other than that necessary to establish their nature, characteristics and proper functioning.

The costs and risks associated with the return are borne exclusively by the Customer. Accordingly, if the Customer uses the prepaid return label provided, the corresponding cost will be deducted from the amount refunded. If the Customer does not use the label, the Customer shall bear the shipping costs directly.

The Customer is advised to retain proof of dispatch of the parcel until the order has been refunded.

10.5 Refund

Subject to the conditions above, MERCI will refund the Customer the amount inclusive of tax paid for the returned Products, less, where applicable, the return costs corresponding to the use of the prepaid label supplied for exercising the right of withdrawal.

Where delivery charges were included in the order amount, these will be refunded up to the cost of the standard delivery method if the Customer returns the entire order.

MERCI will refund the relevant amount within fourteen (14) days from the date on which it was informed of the Customer’s decision to withdraw. The refund may be deferred until MERCI has received the Products returned by the Customer or until the Customer has provided MERCI with proof of dispatch, whichever occurs first.

The refund will be made using the payment method used by the Customer when placing the order.

ARTICLE 11 – INTELLECTUAL PROPERTY

Each Customer acknowledges and agrees that all intellectual property rights, whether registered/protected or otherwise, relating to all information or content appearing on the Site, the Products, their packaging, trademarks and distinctive signs under which the Products are marketed are owned by MERCI or by third parties that have authorised MERCI to use them.

No licence or right other than the right to acquire the Products, physical materials and containers is granted to any person in respect of such intellectual property rights, including labels, packaging, inserts, etc.

Any reproduction, representation, use, adaptation, modification, incorporation, translation or commercialisation, whether partial or complete and by any process or on any medium whatsoever (paper, digital, etc.), is prohibited without the prior written authorisation of MERCI or the relevant rights holders, failing which it may constitute infringement of copyright and/or design rights and/or trademark rights, or unfair competition.

Each Customer therefore undertakes not to infringe the aforementioned rights in any manner whatsoever. More specifically, the Customer expressly undertakes not to manufacture, sell, license or otherwise market, directly or through a third party, for their own benefit or that of a third party, the Products, imitations or reproductions of the Products, or intellectual property rights relating to Products and trademarks belonging to MERCI or third parties that have authorised MERCI to use them.

ARTICLE 12 – PERSONAL DATA

When accessing and using the Site, Personal Data relating to the Customer may be collected and processed by MERCI, which the Customer expressly accepts, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (GDPR) and French Law No. 78-17 of January 6, 1978 relating to information technology, files and civil liberties, as amended.

The methods used to collect and process such data, as well as the use of cookies, are detailed in the Privacy Policy and Cookie Policy available on the Site. These documents form an integral part of these Terms and Conditions.

The Customer may exercise their rights under applicable regulations at any time by contacting MERCI, subject to providing proof of identity:

by post: MERCI – 84 rue Amelot, 75011 Paris, France

by email: eshop@merci.paris

The Customer is also informed that they may lodge a complaint with the CNIL (French Data Protection Authority) and may register free of charge on the French telephone marketing opt-out list in order not to receive commercial solicitation by telephone.

ARTICLE 13 – FORCE MAJEURE

In the event of force majeure within the meaning of Article 1218 of the French Civil Code, the effects of the sales contract shall be suspended and MERCI may, at its sole discretion, cancel the order without incurring liability as a result. In such circumstances, MERCI shall refund the Customer the price of the order and, where applicable, the delivery charges.

Under no circumstances shall MERCI be held liable for any harmful consequences arising from such events.

ARTICLE 14 – VALIDITY OF THE GENERAL TERMS AND CONDITIONS OF SALE

If any provision of these Terms and Conditions is declared wholly or partially invalid pursuant to a law or regulation or following a final decision by a court of competent jurisdiction, the remaining provisions and the other rights and obligations arising from these Terms and Conditions shall remain unchanged and continue to apply.

ARTICLE 15 – COMPLAINTS / DISPUTES – APPLICABLE LAW

15.1 Complaints / Disputes

In the event of a complaint and/or dispute relating to the Site, these Terms and Conditions and/or an order, the Customer is invited to contact MERCI customer service:

If a prior written complaint submitted to MERCI has not resulted in a resolution, the Customer may use, free of charge, a consumer mediator with whom MERCI has entered into an agreement. Pursuant to Article L.612-1 of the French Consumer Code, “Every consumer has the right to use a consumer mediator free of charge with a view to the amicable resolution of a dispute with a professional.”

Disputes falling within the scope of Article L.612-1 of the French Consumer Code are those defined in Articles L.611-1 and L.611-2 of the French Consumer Code, namely contractual disputes concerning the performance of a sales or service contract between a consumer and a professional.

This applies to both domestic and cross-border disputes.

The Customer is invited to submit their request:

Recourse to mediation is optional and the parties remain free to accept or reject the solution proposed by the mediator.

In the absence of an amicable resolution or recourse to mediation, the French courts shall have jurisdiction over any dispute relating to these Terms and Conditions, subject to any mandatory provisions that may confer jurisdiction on a foreign court. In all circumstances, the Customer retains the right to bring proceedings before any court of competent jurisdiction of their choice.
